The attorney general’s office went after NSC-131, the group that hung a “Keep New England White” banner from an overpass in 2022, but the courts rejected the case on free speech grounds.

The New Hampshire Supreme Court held that a local white supremacist group, NSC-13, did not violate the state’s Civil Rights Act when it displayed a banner reading “KEEP NEW ENGLAND WHITE” from an overpass.

The court upheld lower court rulings that found the state Attorney General used an overly broad interpretation of the Civil Rights Act to prosecute members of NSC-131.

The court said the state’s interpretation imposes government sanctions on people who unintentionally trespass on public property.
